Disqualification of Nawaz as Party Chairman and Future of PML-N

Baaghi brings you the decision just issued by Supreme Court to disqualify former prime minister, Nawaz Sharif, from party leadership. This decision in turn will render every decision null and void taken by Nawaz Sharif as a party leader. Two of the major decisions which Sharif has taken after his disqualification was the nomination of PM of Pakistan, Shahid Khaqan Abbasi, and issuance of senate tickets which he personally signed.
According to the verdict:
“Under Article 63-A of the Constitution, the position of a Party Head of a political party that has representation in, inter alia, the Parliament has a central role in the performance of duties by the Members of the Parliament. For rendering such a role, a Party Head must necessarily possess the qualifications and be free of the disqualifications contemplated in Articles 62 & 63 of the Constitution.”
Nawaz Sharif who was disqualified as prime minister in July 2017 in the Panama Papers case kept ruling the party by amending the Constitution of Pakistan to retain his chairmanship of the PML-N.
According to the PM Abbasi, “Nawaz Sharif meray dil kay prime minister hain.”
That is the level of slavish mentality of our PM Abbasi what to talk of other PML-N workers.
Following the disqualification, the Elections Act 2017 was passed by Parliament to fetch Nawaz back into party politics, irrespective of his disqualification from his seat in national assembly.
Pakistan Tehreek-e-Insaf Chairman Imran Khan, Awami Muslim League Chief Sheikh Rashid, MNA Jamshaid Dasti, National Party and the Pakistan Peoples Party (PPP), among others, filed the petition to challenge the law for allowing a disqualified parliamentarian to become a party head.
The decision also indicates to article 232 which means that Nawaz Sharif could be disqualified for the life time.
Petitions challenging specific clauses of the Elections Act 2017, stated that Nawaz’s appointment as party president was in defilement of Clause 5 of the Political Parties Order 2002 and Article 17 of the Constitution.
Marya Nawaz, daughter of Nawaz Sharif, who is hyper active on twitter and has a dedicated media-cell updated her profile picture few minutes ago reading “Main Bhi Nawaz Huun”.
Another important point to ponder is that PML-N is registered in the name of Nawaz Sharif. So, Nawaz Sharif’s disqualification can also jeopardize the very existence of PML-N. The entire PML-N, National and Provincial Assembly will be subject to constitutional crisis in coming days, most likely.
